Milpitas Sleep Specialist Accused of Sexual Misconduct by Patient, Staff, and Job Applicant

Milpitas police say two more individuals have come forward with allegations of sexual misconduct against local pulmonologist and sleep specialist Dr. Sanjay Kumar Agarwal, adding to an ongoing investigation.

Authorities first announced Dr. Agarwal’s arrest in September after a patient reported that he allegedly touched her inappropriately during an appointment at his private Milpitas practice in April. Following public reports of that arrest, police said two former coworkers contacted investigators with similar claims.

According to police, the additional accusers previously worked with Dr. Agarwal at Regional Medical Center in San Jose. They allege he behaved inappropriately toward them while they were hospital employees. The incidents reportedly occurred in 2011 and between 2014 and 2015. No complaints were filed at the time, but the individuals decided to come forward after learning of the recent arrest.

Police said the statute of limitations has expired for those earlier allegations because they occurred more than a decade ago. However, the information has still been forwarded to the Santa Clara County District Attorney’s Office to provide broader context for the investigation.

Separate Criminal Case Involving Job Applicant

Court records also show Dr. Agarwal is facing a separate, active criminal case related to allegations made by a job applicant. According to police reports, a woman interviewing for a medical assistant position at his Milpitas office last year said she was shadowing him when he allegedly stood close to her and pressed his chest against her breast. She also told police he kissed her on the forehead and asked how she would feel about having sex with him in exchange for money.

The woman reported that Dr. Agarwal allegedly told her he would still hire her even if she declined. She said she refused. Dr. Agarwal has pleaded not guilty to misdemeanor sexual battery and soliciting prostitution. That case remains ongoing.

Hospital Affiliations Under Review

Dr. Agarwal has received referrals from physicians associated with major South Bay healthcare systems, including Good Samaritan Hospital, Regional Medical Center, and El Camino Health.

After learning of his September arrest, Santa Clara County health officials, who oversee Regional Medical Center, said he is no longer permitted to treat patients at county facilities. County representatives stated that patient safety is a top priority and that appropriate steps have been taken.

El Camino Health confirmed that Dr. Agarwal does not currently have a contract or clinical privileges within its system.

Good Samaritan Hospital stated that Dr. Agarwal is not an employee and that the alleged incidents did not occur at its facility. Hospital representatives added that established protocols are in place to review credentials and protect patient wellbeing. Dr. Agarwal is reported to still have an active affiliation with the hospital.

Physician Denies Allegations

Reached by phone, Dr. Agarwal denied the accusations, calling them false and saying his attorneys are handling the matter. His attorney declined to provide further comment.
