New preliminary hearing date set for suspect in Sam Altman home attack
The man accused of attempted murder and arson in the Molotov cocktail attack at OpenAI CEO Sam Altman’s San Francisco home was back in court Friday morning.
Prosecutors were ready to lay out their case against Daniel Moreno-Gama during a preliminary hearing, but that did not happen.
Dressed in his orange jumpsuit, Moreno-Gama said two words, answering in the affirmative to waiving his right to a preliminary hearing within 10 days of being charged and extending that time period to the 60-day mark, which means his new preliminary hearing date will be August 5.
Moreno-Gama is charged with a slate of state and federal charges for allegedly throwing a Molotov cocktail at the gate of Altman’s home. Prosecutors say he then went to OpenAI’s headquarters, also in San Francisco, where a federal complaint assesses there is probable cause for attempted damage and destruction to property.
Moreno-Gama’s arraignment on federal charges is scheduled for May 18.
This is the second time this week that Moreno-Gama was in court. On Tuesday, attorneys argued during a bail hearing. The judge ultimately denied the request for bail.
Moreno-Gama is expected to stay in custody throughout his court proceedings.
